Building and property

Our lawyers have excellent credentials in property law, with clients including local government (mainly municipal authorities), housing associations, healthcare providers, architects, consulting agencies, property developers and building contractors as well as private individuals. The building & property sector team offers clients expert consultancy services on matters of civil property law (for issues concerning public property, please consult our government & non-profit team). We also have in-depth knowledge of business law in areas ranging from ownership, ground leases and built structures to easements. Our main expert in this area is Roel Mertens, an endowed professor of property law with a particular specialisation in apartment rights – a field in which our firm is the market leader. Clients with issues relating to impairment of and damage to property are also in good hands.

Naturally, we are well-versed in all the legal ins and outs of property design, construction, maintenance, finance, management and utilisation, both in residential and non-residential construction and in groundwork, road and hydraulic engineering. Our team can advise you on integrated design and building contracts and derivative agreements, and on the critical preliminary phases in negotiation or tendering procedures. Where property utilisation is concerned, we offer solid knowledge of purchase rights (transactions), tenancy and agricultural tenancy rights, as well as other rights of use and management of immoveable property. While our aim is always to avoid conflicts, you can rely on us to conduct legal proceedings before the civil court if need be, or to bring matters for arbitration, mediation or a binding third-party ruling.
