Access to affordable energy is a fundamental right that is laid down in diverse laws, including the Heating Supply Act (Warmtewet) and the Electricity Act (Elektriciteitswet 1998). The energy landscape is changing dramatically. Greenhouse gas reduction targets, efforts to secure future access to energy and keep energy affordable make this a dynamic field of major societal relevance that demands special expertise.
We advise clients on all manner of legal aspects surrounding the supply of energy, such as:
• the installation of heating and cooling networks, geothermal heat pumps and solar panels and establishing the attendant real rights, such as building rights;
• drawing up and assessing supply agreements and general terms and conditions and testing them against the Heating Supply Act and Electricity Act;
• applying for supply licences from the Netherlands Authority for Consumers & Markets (ACM);
• aspects pertaining to public law, such as Section 9(e) of the Electricity Act within the context of wind farms, and aspects of spatial planning such as zoning plans;
• the supply of energy (and renewable energy) by owners’ associations and housing associations and the applicable regulations.
