Public-private partnerships

Our lawyers have extensive experience of shaping public-public and public-private partnerships via administrative agreements, joint regulations, cooperation agreements between public and private parties (with/without a joint legal entity or partnership, or variations on this such as a limited partnership [CV] or private limited company [BV]) and partnerships based on models such as the building rights model, joint venture model, coalition model, concession model and alliance model. They are also well-versed in DBFMO contracts for the design, realisation, financing, maintenance and operation of planned property and infrastructure developments.

Partnerships can take a wide range of forms. This both allows and requires a customised approach to every project and project phase, which in turn requires experienced consultants who can work with clients to speed the process and ensure the right choices are made.
Our firm understands the importance of a balanced distribution of risks between the market and government, of governance aspects and of the need for financing and organisational structures that genuinely support the partnership. We will ensure that the cooperating partners gain the leverage and control they need to jointly make the project feasible, workable, affordable and, ultimately, successful.
Using this approach, we have already worked with various clients to complete dozens of major projects involving urban (re)development, residential construction, industrial park development and infrastructure.
